In this action for the wrongful death of his wife and two children and personal injuries to another child, William McClenanan, Plaintiff-Appellant, appeals the dismissal of his lawsuit against Glenn Cooley, Defendant-Appellee, by the Circuit Court of Bradley County. The central issue presented in this litigation is whether a jury should be permitted to determine the issue of proximate causation in cases where the keys are left in the ignition of a parked automobile that is subsequently stolen and thereafter involved in an accident. For the reasons that follow, we reverse and remand.
